18+ and AI Content Policy

This 18+ and AI Content Policy ("Policy") explains the age requirement, the nature of the Avatars offered through BuildAvatar, and the strict rules that protect against any sexualization of minors. It applies to everyone who accesses or uses BuildAvatar at https://buildavatar.ai (the "Service"), operated by [BuildAvatar legal entity name] ("BuildAvatar", "we", "us", "our"), registered at [registered address]. This Policy forms part of, and should be read together with, our Terms of Service and Privacy Policy.
Because BuildAvatar provides the Avatar and the education and tools around it — and not any monetization, subscription, or payment service — some of the obligations described below sit with other platforms in the workflow, in particular Fanplace. We identify those boundaries clearly throughout.
1. Strictly 18+
The Service is offered only to adults who are at least 18 years old (or the age of majority in your jurisdiction, if higher). The Service is not directed to, and may not be used by, anyone under 18 under any circumstances.
By creating an account, claiming an Avatar, or otherwise using the Service, you represent and warrant that:
- you are at least 18 years of age and have the legal capacity to enter into these terms;
- all registration and account information you provide is true and accurate; and
- you will not permit any person under 18 to access the Service through your account or device.
If we determine, or reasonably suspect, that a user is under 18, we will suspend or terminate the associated account and may take any further action we consider appropriate.
2. How age is verified
Age assurance for the wider workflow is handled in two stages:
- Account creation on BuildAvatar. To open a BuildAvatar account you provide an email address and password and confirm you are 18 or older. We require email verification before the account is active. BuildAvatar does not collect government ID, passport, a selfie-with-ID, or bank details, and does not itself perform documentary identity or age verification.
- Identity and age verification on Fanplace. Before a claimed Avatar can go live and be used for any monetized or published content, identity and age verification must be completed on Fanplace (https://fanplace.com) through Fanplace and its third-party verification providers, under Fanplace's own terms and privacy policy. That verification flow — including any collection of ID documents or biometric checks — takes place on Fanplace, not on BuildAvatar.
A claimed Avatar that is not verified on Fanplace within 72 hours is released back to the pool. In short: BuildAvatar confirms your email and requires your 18+ representation; Fanplace performs the documentary identity and age verification before an Avatar goes live.
3. The AI nature of Avatars
Each Avatar (also called a "Creator") offered through BuildAvatar is an AI-generated, trained model — technically a LoRA built from the trait selections made during design. An Avatar:
- is a synthetic, computer-generated character;
- does not depict a real, identifiable person, and is not a photograph, likeness, or recording of any actual individual; and
- is trained and configured to present as an adult.
Because Avatars are AI-generated and adult by design, they must never be prompted, edited, described, or presented in any way that makes them appear to be, or represent, a minor. This applies regardless of styling, captions, wardrobe, setting, or accompanying text.
4. Zero tolerance for child sexual abuse material and the sexualization of minors
BuildAvatar has an absolute, zero-tolerance prohibition on any content that depicts, describes, or sexualizes a minor, or that presents any person or character as a minor in a sexual context. This prohibition is unconditional and cannot be waived.
Strictly prohibited, without exception, is any attempt to create, request, upload, generate, edit, store, or distribute:
- child sexual abuse material ("CSAM"), in any form;
- sexual, suggestive, or exploitative depictions of a real minor;
- AI-generated, drawn, animated, "age-play", or otherwise simulated content that depicts a minor — or a character that appears to be a minor — in a sexual, suggestive, or exploitative manner;
- content that sexualizes childhood, including through age-regressive styling, settings, wardrobe, props, or language intended to convey that a subject is under 18; and
- any effort to prompt, jailbreak, or otherwise manipulate an Avatar or the Studio toward any of the above.
Enforcement. Violations result in immediate account termination and preservation of the associated data. We report apparent CSAM and related conduct to the National Center for Missing & Exploited Children (NCMEC) and/or to appropriate law-enforcement authorities as required or permitted by law, and we cooperate with lawful investigations. Nothing in any other agreement limits our ability to act under this section.
5. BuildAvatar surfaces are safe-for-work; adult content lives on Fanplace
There is a firm product boundary between what happens on BuildAvatar and where adult content is created and monetized.
- On BuildAvatar (safe-for-work). The Avatar reveal, the Studio previews, the edit tools, and the Resource Hub are intended to be safe-for-work. Content generated on or displayed through BuildAvatar's own surfaces is screened, and we may block, remove, or refuse to process any prompt, edit, or output that violates this Policy or that we consider inappropriate for these surfaces.
- On Fanplace (adult content and monetization). Any adult or sexually explicit content, and all monetization of it — subscriptions, pay-per-view, tips, messaging — takes place on Fanplace under Fanplace's terms, content rules, and age/identity verification. BuildAvatar does not host that explicit content on its own surfaces, does not process subscriber payments, and is not a party to any monetization transaction. Content is created on TJP (https://tjp.com), a separate studio, and monetized on Fanplace (https://fanplace.com), a separate platform.
You remain responsible for ensuring that any content you create, publish, or monetize on TJP, Fanplace, or elsewhere complies with those platforms' rules and with all applicable law.
6. Records-keeping and 18 U.S.C. § 2257
BuildAvatar provides an AI-generated Avatar together with education and tools. BuildAvatar's own surfaces are safe-for-work, and the Avatars are synthetic models that do not depict real, identifiable people.
Accordingly, BuildAvatar is not the "producer" of, and is not the custodian of records for, any sexually explicit content, and does not undertake record-keeping obligations under 18 U.S.C. § 2257, 28 C.F.R. Part 75, or any comparable law. Where sexually explicit content is produced, published, or monetized, any applicable "producer", record-keeping, custodian-of-records, and labeling obligations rest with the creator who produces or publishes that content and with Fanplace as the platform on which it is published — not with BuildAvatar. Any § 2257 disclosures, records, and custodian information for such content are maintained under those parties' own compliance programs.
Nothing in this Policy should be read as BuildAvatar holding itself out as a producer or custodian of records for explicit content.
7. Reporting a suspected underage user or abusive content
If you believe that a user may be under 18, or you become aware of any content that sexualizes a minor or otherwise violates this Policy, report it to us immediately:
- Email: [email protected] (general reports) or [email protected] (legal notices, including our DMCA designated agent)
Please include enough detail for us to locate the account, Avatar, or content in question (for example, links, nicknames, dates, and a description of the concern). Where safe and lawful, do not download, copy, or forward any suspected CSAM; instead, report it to us and, if appropriate, directly to law enforcement or NCMEC.
We review reports of this kind promptly and act on them, including by removing content, suspending or terminating accounts, preserving relevant data, and notifying authorities where required or appropriate. Reports made in good faith are welcomed and, to the extent permitted by law, kept confidential.
8. Changes to this Policy
We may update this Policy from time to time to reflect changes in our Service, our third-party providers, or the law. The "Last updated" date above shows when this Policy was most recently revised. Material changes will be made available through the Service. Your continued use of the Service after an update takes effect means you accept the revised Policy.
