Acceptable Use Policy

This Acceptable Use Policy (the "Policy") governs your access to and use of BuildAvatar, available at https://buildavatar.ai, operated by [BuildAvatar legal entity name] ("BuildAvatar", "we", "us", or "our"). It sets out what you may and may not do when using our website, your Avatar, the Studio, the Resource Hub, and any related features (together, the "Service").
This Policy forms part of, and is incorporated by reference into, the BuildAvatar Terms of Service. Capitalized terms used but not defined here have the meaning given to them in the Terms of Service. If there is any conflict between this Policy and the Terms of Service regarding permitted conduct, this Policy controls. By accessing or using the Service, you agree to comply with this Policy. If you do not agree, you must not use the Service.
1. Scope
This Policy applies to every User of the Service and to all activity conducted through your account, whether by you or by anyone using your credentials. It applies to your use of the Studio, your interactions with your Avatar (or "Creator"), your use of the Resource Hub, and all content you create, submit, generate, edit, or attempt to generate through the Service.
The Service provides a trained AI Avatar together with education and tooling. It is not a content-publishing, subscription, or payment platform. Content creation occurs on TJP, and all monetization occurs on Fanplace. Your use of those separate platforms is governed by their own terms, and their acceptable-use rules apply to you there in addition to this Policy.
2. Eligibility
The Service is strictly for adults aged 18 or older. It is not offered to, and may not be used by, anyone under 18. Providing false information about your age is a violation of this Policy.
3. Prohibited Uses
You must not use, or attempt to use, the Service to do any of the following. This list is illustrative, not exhaustive.
3.1 Unlawful use
- Use the Service for any purpose that is unlawful, or that encourages, facilitates, or promotes any unlawful act, under any law applicable to you.
3.2 Child sexual content — zero tolerance
- Generate, attempt to generate, request, solicit, upload, store, or distribute any content that depicts, sexualizes, or exploits a minor, or that depicts a person who appears to be a minor in any sexual or sexualized context. This prohibition is absolute and admits no exception.
- We enforce a zero-tolerance standard. Any violation, or attempted violation, of this section will result in immediate and permanent termination of your account, preservation of relevant records, and reporting to the appropriate authorities and organizations (including the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement) as required or permitted by law.
3.3 Impersonation and identity
- Impersonate any person or entity, or misrepresent your identity, age, or your affiliation with any person or organization.
- Falsify, omit, or provide misleading registration or account information, including your email address or chosen nickname.
3.4 Real, identifiable persons
- Generate, or attempt to generate, the likeness, face, voice, or other identifying characteristics of a real, identifiable person without holding all necessary rights and that person's consent.
- Use the Service to create content that could reasonably be mistaken for a real individual in a way that violates their rights.
3.5 Harmful and abusive conduct
- Use the Service to harass, bully, stalk, threaten, defame, or intimidate any person.
- Create or promote content that is hateful, or that incites violence or discrimination against any person or group on the basis of a protected characteristic.
3.6 Intellectual property, privacy, and publicity
- Infringe, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or other rights of any third party.
- Upload or use material you do not have the right to use.
3.7 Illegal or harmful goods and activity
- Use the Service to advertise, promote, or facilitate illegal goods, illegal services, fraud, or any other illegal or harmful activity.
3.8 Automated access and extraction
- Access the Service using bots, scrapers, crawlers, or any automated means, or otherwise extract, harvest, or collect data from the Service in bulk, except as we expressly permit in writing.
3.9 Security and integrity
- Probe, scan, or test the vulnerability of the Service or any related system, or breach or circumvent any security or authentication measure.
- Reverse engineer, decompile, or disassemble any part of the Service, or attempt to derive its source code, models, or underlying technology, except to the extent this restriction is prohibited by applicable law.
- Circumvent, disable, or interfere with any usage limit, rate limit, filter, safety control, or access restriction.
- Introduce malware or otherwise interfere with, disrupt, or place an undue load on the Service or its infrastructure.
3.10 Competing products
- Use the Service, or any content, data, model output, or materials obtained from it, to develop, train, or improve a competing product or service.
3.11 Account and Avatar transfer
- Resell, rent, sublicense, transfer, or otherwise make your account or your Avatar available to any third party. Accounts and Avatars are personal to you and non-transferable.
4. Safe-for-Work Surfaces; Adult Content and Monetization
BuildAvatar's own surfaces — including the website, the Studio, and the Resource Hub — are intended to be safe-for-work, and you must not generate or attempt to generate adult, sexually explicit, or otherwise not-safe-for-work content on them.
Any adult or explicit content, and any monetization of such content (including subscriptions, pay-per-view, tips, and messaging), occurs solely on Fanplace, subject to Fanplace's own terms, content standards, age-verification and identity-verification requirements, and any applicable record-keeping laws (including, where applicable, 18 U.S.C. § 2257 and equivalent requirements). BuildAvatar does not process subscriber payments, does not perform identity verification, and is not a party to any monetization transaction. You are responsible for complying with all requirements that apply to you on those separate platforms.
5. Enforcement
We may investigate suspected violations of this Policy and take any action we consider appropriate, at our discretion and without prior notice. Depending on the nature and severity of the violation, this may include:
- removing, disabling, or restricting access to content or to your Avatar;
- issuing a warning;
- temporarily suspending your account or access to the Service;
- permanently terminating your account and reclaiming your Avatar; and
- preserving records and cooperating with law enforcement, regulators, and other authorities, and disclosing information where required or permitted by law.
Certain violations — including any violation of Section 3.2 (child sexual content) — will result in immediate, permanent termination and mandatory reporting, regardless of intent. Our decision to take, or not to take, any enforcement action does not waive our right to act on the same or other conduct in the future.
6. Reporting a Violation
If you become aware of any content or conduct that may violate this Policy, please report it to us at [email protected]. Please include enough detail for us to locate and assess the issue, including relevant links or identifiers and a description of the concern. Reports concerning the suspected sexual exploitation of a minor are treated with the highest priority.
7. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the "Last updated" date below. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Policy.
